Dr. Thomas Gratzer — Background and Court Decisions
Court Findings
Dr. Thomas Gabor Gratzer is a board-certified psychiatrist whose prior conviction was completely vacated by the Minnesota courts. After an appeal and post-conviction review, the courts dismissed the criminal complaint and nullified the conviction, concluding the case had been filed outside the statute of limitations and should never have proceeded to trial.
In June 2024, a Minnesota district court granted Dr. Gratzer’s petition for post-conviction relief, ruling that his trial counsel had been ineffective for failing to assert a clear statute-of-limitations defense. The court determined that a 2019 communication to law enforcement triggered the statutory deadline, and the State’s June 2022 complaint was filed too late under Minnesota law. Because the prosecution was legally time-barred, the court vacated the conviction and dismissed the case outright.
The State appealed, but the Minnesota Court of Appeals affirmed the district court’s decision. The appellate court agreed the complaint was untimely and that Dr. Gratzer’s conviction could not stand. With this ruling, all charges and penalties were nullified, his record cleared, and the case legally resolved in his favor.
